"Medical boards get pushback as they try to punish doctors for Covid misinformation"/ Politico

The medical boards are getting in trouble for swallowing the malarky from the Federation of State Medical Boards and other bloated medical nonprofits. These organizations somehow worked in concert during the second half of 2021 to terrorize doctors who failed to hew to the current medical narrative.  Presumably they got paid to do so.  Presumably those trying to cement control over Americans felt it necessary to act extrajudicially to use threats to enforce only 'approved' medical speech. 
The clueless Medical Licensing Board members, a mix of medical professionals and citizens, rely on attorneys on their staff to get the legal details right.  Instead, the attorneys never told the Board members that none of them them had any authority to legislate new crimes, that misinformation is not a crime under US law, that Freedom of Speech is a foundational principle of law that may not be abrogated, ever, especially not by any state or state agency.
A few Medical Boards, including my own, got too far out over their skis, and now it is starting to sink in what they have done.  Their legislators are saying, "Whoa, Nellie!  You guys were supposed to protect the citizens from incompetence, drunkards, druggies and rapists.  We never asked you to trash the 1st and 14th Amendments."

...the responses from some medical boards and state officials have been stymied by political backlash. States like Tennessee and North Dakota, for example, have restricted state medical boards’ powers. And now legislators in 10 other states — including Florida and South Carolina — have introduced similar measures. 
Some state boards also lack the legal tools to discipline doctors for sharing unreliable information via social media. They believe the precedents in their states for unprofessional or unethical behavior more narrowly apply to actions or speech made directly to patients under their care... 
Meantime, my license remains suspended while the Maine Medical Licensing Board hopes against hope that if they keep fishing, they might someday be able to find a crime with which to charge me. It's your taxpayer dollars they are spending to destroy my career and silence my voice.  They think it is free money.  What do you think?

  3. Dr. Maroulla S. Gleaton, an ophthalmologist and Chair of the Maine Board of Medical Licensure, in her Fall 2021 newsletter threatened Maine practitioners: "Physicians who generate and spread COVID-19 vaccine misinformation or disinformation are risking disciplinary action..." citing a warning from the Federation of State Medical Boards. The FSMB however is a private, non-governmental non-profit organization with NO STATUTORY authority to define or adjudicate medical "misinformation". Dr. Gleason and the board therefore appear to be fantasizing an expanded authority to enforce the political views of "bloated medical nonprofits".

    NGO's and advocacy oriented consultancies have been exploiting false and misleading legal guidance to manipulate corporations and even government agencies over recent years. The nature and extent of those tactics came to public attention in 2019 with the discovery of legal strategy and guidance materials developed by Denton's for IGLYO - an international Transgender rights NGO that focusses on child rights.

    That set-off inquiries within UK government offices which revealed that govt offices across the UK were relying on spurious claims and interpretations of UK gender rights law deriving from those materials. They had been persuaded to do so by LGBT advocacy groups, like Stonewall, that were officially recognized as advisors to the UK Government Equalities Office.

    But those groups had deliberately misrepresented both the requirements and applicability of the laws they were advising on. Basically they had promoted a revised and extended understanding of the law and even disseminated legal statements for incorporation into official policy documents codify those changes.

    The ACLU and NEA had applied very similar tactics to establish some of the more controversial school policies concerning Transgender children that Abigail Shrier has written about. Those were misrepresented as settled law and agency doctrine, in the form of legal requirements that were disseminated to schools and school district offices.

    The activities that Meryl has described seem to follow the same pattern. If these parties were using the same playbook as Stonewall and the ACLU, they would have prepared a package of materials, mostly as slide decks, designed and formatted to present their agenda and objectives as recognized law and policy requirements. The state medical board would have received copies.

  5. I think it is obvious these oversight boards no longer act in the public interest. They have become another link in the appalling political/special interest web entangling the average person seeking advice from a trusted professional ... in this case a well- qualified medical doctor. It seems to me that all the professions are now rigged in some way ... education, banking, Wall St. and the financial industry, health care and the medical industry, ...

    Did anyone think he would see the day when a medical doctor was prevented by government agencies/boards from properly treating a patient? This is taking place world-wide. Why? I think the answer is obvious.

    We get what we accept. We must stop accepting this.

  6. After reviewing the IRS form 990 for the Federation of State Medical Boards (FSMB) along with its crony boards. The American Board of Family Medicine (“ABFM”), the American board of Internal Medicine (“ABIM”), and the American Board of Pediatrics (“ABP”) which issued a joint statement in support of FSMB’s position on silencing Physicians speaking out about Covid.

    I find that the gang of felonious market manipulators have listed more than $314 million invested in the stock market along with an additional slush fund of more than $44 million set up for investing in the market that they have listed in their IRS form 990s.

    They are very blatantly using their positions in the medical community to manipulate the stock market. Market manipulation is illegal in the United States under both securities and antitrust laws. Securities laws and related SEC rules broadly prohibit fraud in the purchase and sale of securities, and the Securities Exchange Act of 1934, Section 9, specifically makes it unlawful to manipulate security prices.

  10. What do I think? I think every member of the Main Medical Licensing board should be fined, fired and then have mandated psychological evaluations.

  11. I think you should sue any and all that made statements in their individual capacity for defamation. I would challenge any sovereign immunity they try to present. Scare them and make them realize there are legal consequences for playing fast and loose with the law. People would crowdfund a legal fund if you can’t find an attorney licensed in Maine to take a case on contingency. Also they should be enjoined from any action against your medical license as clearly they lack the legal authority to sanction you for spreading “misinformation”.

    Robert Kennedy Jr. must know someone who could sponsor him as pro hac vice in Maine or someone great willing attorney in Maine?

  12. 42 US Code 1983 says:

    "Every person who, under color of any statute, ordinance, regulation, custom, or usage, of any State or Territory or the District of Columbia, subjects, or causes to be subjected, any citizen of the United States or other person within the jurisdiction thereof to the deprivation of any rights, privileges, or immunities secured by the Constitution and laws, shall be liable to the party injured in an action at law, suit in equity, or other proper proceeding for redress..."

    I'm no lawyer, but it looks to me like this might be the legal authority you need to sue the medical board members in their individual capacity.

    The board members may also be required to hold surety bonds. You might be able to file complaints with the board member's bond company, who would then investigate your complaint at the board member's expense. I'm not sure about this, but it might be worth a try. See:
